BackgroundAs moral case deliberations (MCDs) have increasingly been implemented in health care institutions as a form of ethics support, it is relevant to know whether and how MCDs actually contribute to positive changes in care. Insight is needed on what actually happens in daily care practice following MCD sessions. This study aimed at investigating the impact of MCD and exploring how ‘impact of MCD’ should be conceptualized for future research.MethodsA multiple-case study was conducted in a care organization for people with (...) intellectual disabilities and/or acquired brain injury, by observing MCD sessions as ‘cases’, followed by interviews with health care professionals concerning the follow-up to these cases, and a focus group with involved MCD facilitators. A conceptual scheme concerning the possible impact formed the basis for analysis: (1) individual moral awareness; (2) the actions of health care professionals; (3) collaboration among health care professionals; (4) the concrete situation of the client; (5) the client’s quality of care and life; (6) the organizational and policy level.ResultsAccording to interviewees, their moral awareness and their collaboration, both among colleagues and with clients’ relatives, improved after MCD. Perceived impact on client situation, quality of care/life and the organizational level varied among interviewees or was difficult to define or link to MCD. Three aspects were added to the conceptual scheme concerning the impact of MCD: (a) preparations and expectations prior to the MCD session; (b) a translational step between the conclusions of the MCD session and practical events in the following period, and (c) collaboration with clients’ relatives. A negative impact of MCD was also found on misunderstandings among participants and disappointment about lack of follow-up.ConclusionsConcretizing and conceptualizing the ‘impact’ of MCD is complicated as many factors play a role either before or during the transition from MCD to practice. It is important to consider ‘impact’ in a broad sense and to relate it to the goals and context of the MCD in question. Future studies in this field should pay additional attention to the preparations, content and process involved in ethics support, including clients’ and relatives’ experiences. (shrink)

This article deals with the question of how ethicists respond to practical moral problems emerging in health care practices. Do they remain distanced, taking on the role of an expert, or do they become engaged with nurses and other participants in practice and jointly develop contextualized insights about good care? A basic assumption of dialogical ethics entails that the definition of good care and what it means to be a good nurse is a collaborative product of ongoing dialogues among various (...) stakeholders engaged in the practice. This article discusses the value of a dialogical approach to ethics by drawing on the work of various nursing scholars. We present a case example concerning the quality of freedom restrictions for intellectually disabled people. Issues for discussion include the role and required competences of the ethicist and dealing with asymmetrical relationships between stakeholders. (shrink)

Legal and moral reasoning share much methodology, and they address similar problems. This volume charts two shared problems: the relation between theory, principles and particular judgments; and the role of facts and factual assertions in normative settings. The relation between 'theory' and 'practice' and between 'principle' and 'particular judgment' has become the subject of much debate in moral philosophy. In the ongoing debate, some moral philosophers refer to legal philosophy for a support of their views on the primacy of 'practice' (...) over 'theory'. According to them, legal philosophy should have a more balanced view in that relation. In the contributions to Part One this claim is critically analysed. The role of the facts is underestimated in discussions on legal reasoning and legal theory, as well as moral reasoning and ethical theory. Factual statements enter into moral and legal discussions not only because they link the conclusion with a rule. They also play a role as background assumptions in supporting a theory. Its focus on the role of facts in normative reasoning makes this book of special interest to scholars of legal and moral argumentation. (shrink)

Introduction: In The Netherlands, physicians have to be convinced that the patient suffers unbearably and hopelessly before granting a request for euthanasia. The extent to which general practitioners (GPs), consulted physicians and members of the euthanasia review committees judge this criterion similarly was evaluated. Methods: 300 GPs, 150 consultants and 27 members of review committees were sent a questionnaire with patient descriptions. Besides a “standard case” of a patient with physical suffering and limited life expectancy, the descriptions included cases in (...) which the request was mainly rooted in psychosocial or existential suffering, such as fear of future suffering or dependency. For each case, respondents were asked whether they recognised the case from their own practice and whether they considered the suffering to be unbearable. Results: The cases were recognisable for almost all respondents. For the “standard case” nearly all respondents were convinced that the patient suffered unbearably. For the other cases, GPs thought the suffering was unbearable less often (2–49%) than consultants (25–79%) and members of the euthanasia review committees (24–88%). In each group, the suffering of patients with early dementia and patients who were “tired of living” was least often considered to be unbearable. Conclusions: When non-physical aspects of suffering are central in a euthanasia request, there is variance between and within GPs, consultants and members of the euthanasia committees in their judgement of the patient’s suffering. Possible explanations could be differences in their roles in the decision-making process, differences in experience with evaluating a euthanasia request, or differences in views regarding the permissibility of euthanasia. Lists of species underpin many fields of human endeavour, but there are currently no universally accepted principles for deciding which biological species should be accepted when there are alternative taxonomic treatments (and, by extension, which scientific names should be applied to those species). As improvements in information technology make it easier to communicate, access, and aggregate biodiversity information, there is a need for a framework that helps taxonomists and the users of taxonomy decide which taxa and names should be used (...) by society whilst continuing to encourage taxonomic research that leads to new species discoveries, new knowledge of species relationships, and the refinement of existing species concepts. Here, we present 10 principles that can underpin such a governance framework, namely (i) the species list must be based on science and free from nontaxonomic considerations and interference, (ii) governance of the species list must aim for community support and use, (iii) all decisions about list composition must be transparent, (iv) the governance of validated lists of species is separate from the governance of the names of taxa, (v) governance of lists of accepted species must not constrain academic freedom, (vi) the set of criteria considered sufficient to recognise species boundaries may appropriately vary between different taxonomic groups but should be consistent when possible, (vii) a global list must balance conflicting needs for currency and stability by having archived versions, (viii) contributors need appropriate recognition, (ix) list content should be traceable, and (x) a global listing process needs both to encompass global diversity and to accommodate local knowledge of that diversity. We conclude by outlining issues that must be resolved if such a system of taxonomic list governance and a unified list of accepted scientific names generated are to be universally adopted. (shrink)

Intractability is a growing concern across the cognitive sciences: while many models of cognition can describe and predict human behavior in the lab, it remains unclear how these models can scale to situations of real-world complexity. The authors explore whether the need for ethical reflection on the part of designing engineers is dependent on the type of design process. They use Vincenti's distinction between normal and radical design and different levels of design hierarchy. These two dimensions are coupled with the concept of ill-structured problems, which are problems in which possible solutions cannot be ordered on a scale from better to worse. Design problems are better structured at lower hierarchical levels and in cases of normal design. (...) Better structured design problems require less ethical reflection on the part of designing engineers if such situations are characterized by the existence of generally accepted normative frameworks. Engineers could then deal with moral problems within the bounds of such frameworks and without the need for further reflection. On the basis of a number of empirical cases, the authors explore whether these ideas hold water. We invite systematic consideration of the metaphors of cycles and circulation as a long-term theme in the history of the life and environmental sciences and medicine. Ubiquitous in ancient religious and philosophical traditions, especially in representing the seasons and the motions of celestial bodies, circles once symbolized perfection. Over the centuries cyclic images in western medicine, natural philosophy, natural history and eventually biology gained independence from cosmology and theology and came to depend less on strictly circular forms. As potent ‘canonical (...) icons’, cycles also interacted with representations of linear and irreversible change, including arrows, arcs, scales, series and trees, as in theories of the Earth and of evolution. In modern times life cycles and reproductive cycles have often been held to characterize life, in some cases especially female life, while human efforts selectively to foster and disrupt these cycles have harnessed their productivity in medicine and agriculture. But strong cyclic metaphors have continued to link physiology and climatology, medicine and economics, and biology and manufacturing, notably through the relations between land, food and population. From the grand nineteenth-century transformations of matter to systems ecology, the circulation of molecules through organic and inorganic compartments has posed the problem of maintaining identity in the face of flux and highlights the seductive ability of cyclic schemes to imply closure where no original state was in fact restored. More concerted attention to cycles and circulation will enrich analyses of the power of metaphors to naturalize understandings of life and their shaping by practical interests and political imaginations. This paper shows how propositional dynamic logic can be interpreted as a logic for multi-agent belief revision. For that we revise and extend the logic of communication and change of [9]. Like LCC, our logic uses PDL as a base epistemic language. Unlike LCC, we start out from agent plausibilities, add their converses, and build knowledge and belief operators from these with the PDL constructs. We extend the update mechanism of LCC to an update mechanism that handles belief change as (...) relation substitution, and we show that the update part of this logic is more expressive than either that of LCC or that of doxastic/epistemic PDL with a belief change modality. Looking back at the twentieth century the question is what we have 'learned' in the field of philosophy in that century. In the case of philosophy 'learning' is understood as getting a more adequate insight into the frameworks in terms of which we spell our experience, in particular as getting an eye for aspects of it that were overlooked or insufficiently noticed in the philosophy of earlier periods. In that connection four themes are discussed: 1. subjectivity and inwardness, i.e. the (...) issue of the special mode of being of the subject ; 2. intersubjectivity and connectedness, i.e. the 'discovery' that by the relation between subjects a very special dimension of reality is indicated that cannot be adequately characterized in terms of the subject-object relationship ; 3. mediation, the issue that meanings are always context and tradition bound, that subjectivity, mind, etc., manifest themselves only as 'incarnated', mediated by nature ; and 4. the evolution from a uniform to a manifold concept of rationality and experience. Twenty-five years ago, robotics guru Joseph Engelberger had a mission to motivate research teams all over the world to design the ‘Elderly Care Giver’, a multitasking personal robot assistant for everyday care needs in old age. In this article, we discuss how this vision of omnipotent care robots has influenced the design strategies of care robotics, the development of R&D initiatives and ethics research on use of care robots. Despite the expectations of robots revolutionizing care of older people, the role (...) of robots in human care has remained marginal. The value of world trade in service robots, including care robots, is rather small. We argue that the implementation of robots in care is not primarily due to negative user attitudes or ethical problems, but to problems in R&D and manufacturing. The care robots currently available on the market are capable of simple, repetitive tasks or colloquial interaction. Thus far, also research on care robots is mostly conducted using imaginary scenarios or small-scale tests built up for research purposes. To develop useful and affordable robot solutions that are ethically, socially and ecologically sustainable, we suggest that robot initiatives should be evaluated within the framework of care ecosystems. This implies that attention has to be paid to the social, emotional and practical contexts in which care is given and received. Also, the political, economic and ecological realities of organizing care and producing technological commodities have to be acknowledged. It is time to openly discuss the drivers behind care robot initiatives to outline the bigger picture of organizing care under conditions of limited resources. (shrink)

: According to a consensus of psycho-physiological and philosophical theories, color sensations (or qualia) are generated in a cerebral "space" fed from photon-photoreceptor interaction (producing "metamers") in the retina of the eye. The resulting "space" has three dimensions: hue (or chroma), saturation (or "purity"), and brightness (lightness, value or intensity) and (in some versions) is further structured by primitive or landmark "colors"—usually four, or six (when white and black are added to red, yellow, green and blue). It has also been (...) proposed that there are eleven semantic universals—labeling the previous six plus the "intermediaries" of orange, pink, brown, purple, and gray. There are many versions of this consensus, but they all aim to provide ontological, epistemological and semantic blueprints for the brute fact of the reality of color ordained by Nature (evolution). In contrast to this consensus, we have argued that "seeing color" is not a matter of light waves impacting on our eyes, producing sensations to be categorized and labeled in the "color space" in the brain. While electrochemical events may unproblematically be regarded as the causal precondition for seeing color, the reception of sensations in "the color space" as semantically labeled natural categories, kinds, or information, is a "just so" story: it is Wittgenstein's beetle in a box. In contrast we consider that the authority of this consensus might better be regarded not as the result of the truth-tracking of nature, but as the sociohistorical outcome of philosophical presuppositions, scientific theories, experimental practices, technological apparatus, and their feed forward into the lifeworld. The question we shall therefore explore is whether, or to what extent, we ourselves are changed, as the conditions of production of color science change. Thus we are doing a kind of anthropology at two levels: of color science itself (and its effect on our own lifeworld), and of those studied by the "anthropology of color". As befits this stance we are agnostic about the theoretical entities of color science (cf. van Fraassen 2001), and within this new context, we propose to cross-cut object-and-subject, organism-and-environment (the bedrock of color science) in socio-historical ways. Our approach is in part inspired by, but not the same as, that of Gibson, in that we wish to pursue the notion of "social affordances" (Burmudez 1995). We suggest that color has become a naturalization through science-based technologies, which, through praxes and materializations, have become the perceptual and cultural entities that structure experience and understanding in the lifeworld. It is this naturalization that we shall refer to and characterize as "the historically inflected exosomatic organ". Consequently we shall explore the historical ontology of "color" without assuming an underlying biological constant (Dupré 2001). In part 1 we show the flimsiness of the evidence for the three dimensions of color, borrowed from physics, and fine-tuned to a "standard observer" (a "spectral creature" with a phenomenal "color space"). In part 2 we address the structuring of hue through the development of color circles and color spaces. This is followed by a review of the evidence for unique hues. Again the evidence is shown to be flimsy. We then show that an isolated domain of color is a particular kind of model, not a "natural given". In part 3, after reviewing what is referred to as "the isomorphy thesis," we discuss the exemplary case study of Berlin and Kay (1969). This illustrates the pull of stadial models presupposed by their evolutionary theory of color language. The Berlin and Kay paradigm proposes that American English color terms are incorrigible and can provide the universal metalanguage. We conclude by presenting an alternative account, namely that we ourselves are changed as the conditions of production of color science change. We argue that it is better to regard "seeing-color" as a historically inflected exosomatic organ that provides social affordances for those trained to grasp them. (shrink)

Maria Van Erp Taalman KipIn Sophocles' Electra 563–76 Electra explains what happened at Aulis. Because Agamemnon had shot a stag in Artemis' grove and boasted of his deed, the goddess demanded the sacrifice of his daughter. If he refused, the Greeks would not be allowed to leave Aulis, either to go home or to sail to Troy. Thus, (...) Electra assures her mother, he was forced to make the sacrifice, "under sore constraint and with sore reluctance" (tr. Jebb, Sophocles ad loc).The same version of the story is found in the Cypria(Davies, Fragmenta 32, 55–63), but Sophocles adds a new detail: the impossibility of going home. This is a significant addition. According to the Cypria, Agamemnon could have renounced the war in order to save Iphigeneia, but this solution was not open to his Sophoclean namesake, since refusal meant the Greeks were doomed to remain at Aulis, more or less as prisoners. In this way, we are given to understand that for Sophocles' Agamemnon there was in effect no alternative. This considerably lessens his guilt, while Clytaemnestra is largely deprived of what might have been a righteous motive for her deed. The other motive, her adulterous love, now carries all the weight. But is what Electra says true? Or, to be more precise: are the audience meant to accept her information as true?A number of scholars have answered this question in the negative and it may be useful to begin by examining their arguments. In his article with the telling title "A Defence of Sophocles" J. T. Sheppard asks: "What if the story... were false? 'They tell me...,' she says (566). But what if it were not true? What if Agamemnon was a criminal?" (7). J. H. Kells (Electra), in his general introduction to 566–633, ridicules the whole story as recounted by Electra: "This was the popular belief as to how such unpleasantnesses as Ajax's madness and the Greeks' detention at Aulis came about. But did Sophocles expect an intelligent person to believe it? I do not think so, since in Ajax, in which such causes of Ajax's madness are ventilated, we are also given a behind–the–scenes picture [End Page 517] of the goddess concerned in action (Ajax 1–133), and there we see that the madness of Ajax was in fact inspired by no such divine jealousy: it was simply to prevent Ajax from killing the Greek leaders (51)—an aim which he conceived through no divine infatuation, but because he was angry over the bestowal of the arms of Achilles (41)."Kells' comment on 573 is also noteworthy: : did any intelligent Greek really believe this?" and on 566ff: " 'as I am told.' Does not she know why her father sacrificed her sister?" In the same vein R. P. Winnington–Ingram (Sophocles 220) says that "Electra's account of Aulis, admittedly second–hand ( 566), is the story she would like to believe; and we can hardly suppose that Sophocles wishes us to take it too seriously as an explanation of events." In a note he refers to Kells and adds: "If Sophocles had been concerned to give a serious account of Agamemnon's dilemma, he would hardly have trivialized it in the way he does. The fact remains that Agamemnon did kill his daughter."1On closer inspection, these arguments are not actually arguments at all. Both Kells and Winnington–Ingram appear to be very certain about Sophocles' intentions and expectations, but neither of them presents any convincing reason to disbelieve Electra's account. Sophocles does not give them what they want and therefore they assume that he is not serious. Winnington–Ingram may consider Agamemnon's dilemma trivial, but it makes no sense to say that Sophocles trivialized it, as if it were something real that existed outside of myth. For the purpose of this play, the reason for Artemis' demand was not relevant, but the sanction was. And what about Kells' rhetorical questions? Many prepared actions have to be withheld for a certain amount of time in order to have the most beneficial outcome. Therefore, keeping track of time accurately is vital to using temporal regularities in our environment. Traditional theories assume that time is tracked by means of a clock and an “attentional gate” (AG) that modulates subjective time if not enough attentional resources are directed toward the temporal process. According to the AG theory, the moment of distraction does not have an (...) influence on the subjective modulation. Here, we show, based on an analysis of 28,354 datasets, that highly motivated players of the online multiplayer real‐time strategy game StarCraft2 indeed respond later to timed events when they are distracted by other tasks during the interval. However, transient periods of distraction during the interval influence the response time to a lesser degree than distraction just before the required response. We extend the work of Taatgen, van Rijn, and Anderson (2007) and propose an alternative active check theory that postulates that distracted attention prevents people from checking their internal clock; we demonstrate that this account better predicts variance observed in response time. By analyzing StarCraft2 data, we assessed the role of attention in a naturalistic setting that more directly generalizes to real‐world settings than typical laboratory studies. (shrink)

Stuart Kauffman has, in recent writings, developed a thought-provoking and influential argument for strong emergence. The outcome is his Theory of the Adjacent Possible (TAP). According to TAP, the biosphere constitutes a non-physical domain qualitatively distinct from the physical domain. The biosphere exhibits strongly emergent properties such as agency, meaning, value and creativity that cannot, in principle, be reduced to the physical. In this paper, I argue that TAP includes various (explicit or implicit) metaphysical commitments: commitments to (1) scientific realism, (...) (2) downward causation and teleology, and (3) modal realism. If TAP is to hang together as the kind of robust philosophical thesis it evidently aspires to be, it needs an account – an account that is currently absent – of its metaphysical commitments. It is however unclear how such an account can be developed since various dilemmas present themselves when one explores how subscribers to TAP might do so. (shrink)

The credit policy of the«Communal Bank» is based on objective criteria in order to respect local autonomy. The financial results of the consolidation are difficult to determine. Several factors could have influenced the present state of municipal finances : the consolidation being done in a period of economic difficulties, the crisis of the public finances, the reform of the Municipal Fund, and the transformation of the Centers for Public Assistance into Public Centers for Social Welf are. The consolidations did not (...) generale any savings, but it al,so did not cause an alarming increase of expenses. With respect to budget balancing, the amalgamated municipalities should do better than the non-amalgamated municipalities. To keep the increase of expenses low in comparison with the revenues, the municipalities had to make cuts in several sectors.As to the current fniancial situation in the three regions, the municipalities of the Brussels regon are in a very painful situation ; in Flanders, the number of municipalities with deficits is higher than in Wallonia, but the deficits in W allonia are bigger. To stop this negative evolution one must strive for balanced budgets and reshape them into reliable instruments. (shrink)

Kant's Grundlegung zur Metaphysik der Sitten is popular as an introduction into his philosophy and into fundamental ethics in general. Its third chapter is, nevertheless, a notoriously difficult text. According to many interpreters, it raises questions rather than answering them. This article tries to answer some questions which often remain unclear even in the secondary literature: how is the logical structure of the chapter; what exactly is the synthetic character of the categorical imperative; how does freedom function as the third, (...) connecting term in this synthesis; what is the relationship between questions concerning the possibility and the validity of the categorical imperative? In his own words, Kant wants to give here 'a deduction of the principle of morality' but also of the concept of freedom. The double use of the term 'deduction' needs an accurate interpretation. One thesis of the article is that the deduction of freedom must not be identified with the problematic deduction of the categorical imperative. The deduction of the concept of freedom has a more modest function within the proof of the possibility of the categorical imperative. This means that the question concerning the proof of its validity is still open; but the very idea that such a proof is neither possible nor necessary evokes already the notion of the factum der Vernunft. In this target article the following hypotheses are discussed: (1) Colour is autonomous: a perceptuolinguistic and behavioural universal. (2) It is completely described by three independent attributes: hue, brightness, and saturation: (3) Phenomenologically and psychophysically there are four unique hues: red, green, blue, and yellow; (4) The unique hues are underpinned by two opponent psychophysical and/or neuronal channels: red/green, blue/yellow. The relevant literature is reviewed. We conclude: (i) Psychophysics and neurophysiology fail to set nontrivial constraints on colour categorization. (ii) Linguistic (...) evidence provides no grounds for the universality of basic colour categories. (iii) Neither the opponent hues red/green, blue/yellow nor hue, brightness, and saturation are intrinsic to a universal concept of colour. (iv) Colour is not autonomous. (shrink)

We seek to add to the Corporate Social Responsibility (CSR) and Sustainable Development (SD) literature through the empirical study of Latin American firm membership in the United Nations Global Compact (GC) and Global Report Initiative (GRI). Within an institutional-based framework, we explore through three filters – commercial, state-signaling, and distinguished peers – the impact of normative and mimetic pressures associated with GC/gri membership. Our sample includes 207 public firms from six Latin American countries (Argentina, Brazil, Chile, Colombia, Mexico, and Peru). (...) Our results suggest Latin American firms from countries with a greater European influence (normative pressure) are twice as likely to be enrolled in the GC/gri. Additionally, we find that Latin American firms listed on the NYSE (mimetic pressure) are also twice as likely to sign up under the GC/gri. Hence, the normative and mimetic pillars of institutional theory are found to be significant factors for Latin American firms adopting sustainability initiatives. (shrink)
